These Terms of Service (“Terms”) govern your access to and use of friscoengagementrings.com (the “Site”), operated by Frisco Engagement Rings (“Frisco Engagement Rings,” “we,” “us,” or “our”). By accessing or using the Site, placing an order, or creating an account, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on this Site. By using the Site, you represent that you meet this requirement and that any information you provide is accurate and current.

2. Products, Descriptions & Disclosures

We make reasonable efforts to accurately describe our jewelry, including metal type and karat weight, diamond and gemstone characteristics, and whether a stone is natural, lab-created, or simulated. In accordance with FTC guidance on jewelry advertising:

•     Metal content and quality marks (e.g., 14K, 18K, platinum alloy composition) are disclosed on each product page.

•     Gemstone treatments (such as clarity enhancement or irradiation), where applicable, are disclosed on the product page.

•     Natural, lab-created, and simulated stones are clearly distinguished in product titles and descriptions.

Colors, textures, and proportions may vary slightly from photographs due to display settings and the handmade nature of fine jewelry. Weights (including total carat weight) are approximate and may vary within standard industry tolerances.

3. Pricing & Payment

All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable sales tax or shipping/insurance costs, which are calculated at checkout. We reserve the right to correct pricing errors, including after an order has been placed; if a correction affects your order, we will contact you before charging the corrected amount and you may cancel at no cost.

4. Order Acceptance

Your order is an offer to purchase, which we may accept or decline at our discretion — for example, in cases of suspected fraud, pricing errors, or inventory unavailability (relevant for one-of-a-kind or made-to-order pieces). We will notify you if we are unable to fulfill your order.

5. Shipping & Risk of Loss

Given the value of fine jewelry, all orders are shipped fully insured and typically require a signature on delivery. Risk of loss passes to you upon our carrier’s confirmed delivery. 6. Custom & Made-to-Order Items

Custom designs, engraving, and ring resizing are made specifically for you. Production timelines for custom or made-to-order pieces will be communicated at the time of purchase and are estimates, not guarantees.

7. Intellectual Property

All content on the Site — including text, graphics, logos, product photography, and design elements — is owned by or licensed to Frisco Engagement Rings and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent.

8. Accounts

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.

9. Prohibited Uses

You agree not to:

•     Use the Site for any unlawful purpose or in violation of these Terms;

•     Attempt to gain unauthorized access to the Site, other accounts, or our systems;

•     Use automated means (bots, scrapers) to access the Site without our permission;

•     Interfere with the Site’s operation or security.

10. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS EXPRESSLY STATED IN OUR PRODUCT WARRANTY OR RETURN & REFUND POLICY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRISCO ENGAGEMENT RINGS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold Frisco Engagement Rings harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

13. Dispute Resolution & Arbitration

Please read this section carefully — it affects your legal rights. Except for disputes eligible for small claims court, any dispute arising out of or relating to these Terms or your purchase will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court. You and Frisco Engagement Rings each waive the right to a jury trial and to participate in a class action. You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, and (for any matter not subject to arbitration) the state and federal courts located in Collin County, Texas shall have exclusive jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
